INCOME REPLACEMENT BENEFITS:

The Statutory Accident Benefits Schedule in Ontario provides financial support to those who cannot work due to injuries suffered in a car accident. This aid comes in the form of income replacement benefits as part of your settlement.

Income replacement benefits are offered to those whose injuries from the accident prevent them from working or from working at the same level as before the accident. This could be due to physical or emotional issues, like severe back pain or post-traumatic stress disorder.

To qualify for Income Replacement Benefits in Ontario, you need to meet certain conditions, including being severely injured to the extent that you cannot work as you did prior to the accident. If you do not meet all the conditions, you might still be eligible for non-earner benefits.

Income Replacement Benefits, calculated based on gross income, are disbursed bi-weekly, with a limit of $400 per week. You could also receive compensation for past and future loss of income beyond these benefits by filing a personal injury claim, such as a slip and fall claim. Income Replacement Benefits are provided at their maximum rate for up to 104 weeks. However, any income lost in the first week of disability is not compensated for.

To be eligible for income replacement benefits, you need to have injuries severe enough that they prevent you from working or from working as before. Also, you must meet one or more of the following conditions:

  • Being employed at the time of the accident, including self-employment.
  • Having worked for at least 26 out of the 52 weeks preceding the accident.
  • Receiving Employment Insurance at the time of the accident.
  • Being unemployed but at least 16 years old and excused from attending school at the time of the accident.

Note: If you meet one of these conditions, you can opt for non-earner benefits instead of Income Replacement Benefits.

You can receive payments covering up to 70% of your gross weekly income, based on your employment history just before the accident. These benefits are paid at least every two weeks but do not exceed $400 per week.

For those employed at the time of the accident, benefits are typically calculated based on:

  • Your gross income in the 52 weeks prior to the accident; or
  • Your gross income in the four weeks before the accident, multiplied by 13.

Your final benefit amount will be adjusted depending on other sources of income replacement you might receive.

After a motor vehicle accident, you can recover money for the days you missed work due to an injury. However, no compensation is provided for the first 7 days after an accident. This does not apply to other types of injury claims.

Accident victims may file a lawsuit against a negligent driver responsible for the collision in addition to collecting no-fault accident benefits.

While they may recover 70% of gross earnings until the trial date, they may recover 100% of gross income loss and earning capacity after the trial.

The amount you receive for past or future income loss will be reduced by income you receive from other sources. The person or entity responsible for paying your damages is usually entitled to deduct any other benefit amounts from the amount of your lost future or past income.

DISABILITY

  • If you suffer serious injuries, you may be unable to work or you may be unable to carry on your normal life.
  • If you are disabled due to an accident, you may be eligible to apply for an income replacement benefit, based on 70% of your gross income to a maximum of $400 per week, with a one-week waiting period.
  • If you fall under a “non-earner” category, you may be eligible for non ear benefits if you suffer a complete inability to carry on a normal life. This would entitle you to $185.00 per week with a four-week waiting period.

MEDICAL

  • Your insurance policy will cover you for reasonable and necessary treatment with any of the following healthcare practitioners due to the accident:

  • If your injuries are considered “Catastrophic”, you will have access to $1,000,000.00 of Medical Rehabilitation Benefits over your lifetime.

DEATH & FUNERAL BENEFITS

  • If as a result of an accident, a death occurs, we can assist with helping you access payments to survivors of a person who is deceased up to $25,000
  • You may also receive payment of funeral expenses up to $6000
